Divorce is stressful, but the legal process doesn’t have to be confusing. Mortazavi & Bennett guides you through filings, temporary orders, discovery, settlement, and trial preparation—always with your goals and your children’s best interests in focus.
What we handle: Contested/uncontested divorce, temporary orders, discovery, division of assets/debts, support, protective orders, trial prep.
Our process: 1) Strategy call 2) File & serve 3) Temporary orders 4) Discovery/mediation 5) Settlement or trial.
When the process changes: However, not all cases are this simple. There are a handful of things that can come in and require numerous court appearances and hearings. Most of the time this is a contested divorce involving the custody of minor children. If that is the case, we still remain prepared to advise our clients of the best steps to take depending on the facts of their case.
FAQ:
• How long does an Oklahoma divorce take?
It depends. I know that is the typical lawyer response but it is the truth. No two cases are the same. If everything is agreed upon, it can take just a few months. If it is a divorce that is highly contested involving child custody, visitation, and asset division, it could take years. No matter what type of litigation you have, Mortazavi & Bennett, PLLC has handled similar matters and can properly advise you of what we believe is the best course of action throughout your legal representation through our firm.
• Who stays in the home during the case?
Either or both can remain in the home during a divorce action. This changes if a protective order is present because of the protections it provides through forcing distance and no contact with the other party. If that is the case, one of you will be out of the home.
• What if my spouse hides income or assets?
If assets are being hidden, the discovery process will weed it out 9/10. You can "think" they have something hidden but to be actionable we need some modicum of proof to be able to say it wasn't disclosed to us and to have us go find it. Luckily for you, if you get a divorce and later it is found out that they purposefully hid that asset from you and it was not disclosed in the course of litigation, you may have the ability to vacate your decree of divorce and go after that asset.
